Sound of Silence
In the recent decisions of United States v. Velarde-Gomez, 2000 U.S.App.Lexis 22941 (9th Cir. Sept. 13, 2000), and United States v. Whitehead, 200 F.3d 634 (9th Cir. 2000), the 9th U.S. Circuit Court of Appeals reaffirmed that defendants in this circuit can exclude evidence of silence if it occurs prior to their receipt of Miranda warnings.
