Law Revision Commission proposes exception to mediation confidentiality
After four years of debating mediation confidentiality exceptions against much opposition, the California Law Revision Commission has preliminarily endorsed the idea that anything said or written in a mediation should be admissible in court.
After four years of debating mediation confidentiality exceptions against much opposition, the California Law Revision Commission has preliminarily endorsed the rule that anything said or written in a mediation be admissible in court regarding attorney malpractice cases.
The commission has asked for further analysis and set a Dec. 1 date in Sacramento to approve its final recommendation to the Legislature.
