New law mandates attorney before children waive Miranda rights
Children 15 and younger can no longer waive their Miranda rights without first consulting an attorney, according to a new law.
As of Jan. 1, 2018, children 15 and younger will no longer be able to waive their Miranda rights without consulting an attorney under a law signed Wednesday by Gov. Jerry Brown.
Authored by Sens. Ricardo Lara, D-Bell Gardens, and Holly Mitchell, D-Los Angeles, SB 395 was among five criminal justice bills signed by the governor on Wednesday, many of them focusing on juveniles in the criminal justice system.
