Many attorneys view appellate lawyers like me as scholarly nerds, parsing ancient cases for tidbits of dicta that support a novel argument. I do that occasionally. But I actually spend most of my time telling stories.

I do that occasionally. But I actually spend most of my time telling stories. The guts of my brief are the statement of facts. If that doesn't persuade -- all by itself -- the fancy research and polemics that follow are unlikely to do the trick. So I think a lot about how best to tell a story.
