Circuit panel reverses judge's order for law firm in debt collector dispute

U.S. District Judge David O. Carter concluded that the tenants’ federal suit constituted an improper appeal of a state court judgment and thus was barred by Rooker-Feldman. But the circuit panel disagreed.

A panel of 9th U.S. Circuit Court of Appeals judges reversed on Tuesday an Orange County federal judge’s summary judgment, which held that an action under the Fair Debt Collection Practices Act against a prominent landlord-tenant law firm was barred by the Rooker-Feldman doctrine.
