Cities' climate lawsuit can remain in state court, 9th Circuit rules

California cities and counties have filed lawsuits accusing the oil companies of producing energy from fossil fuels that has fueled a global warming-induced rise in the sea level, damaging wastewater treatment systems and stormwater infrastructure.

In a procedural win Monday, the cities of San Francisco and Oakland defeated a bid by several major oil companies to move their lawsuit from state to federal court.

The unanimous ruling by a 9th U.S. Circuit Court of Appeals panel is the third decision by the appellate court to allow the public nuisance claims by several California cities and counties to move forward in state court.
