Girardi’s behavior determines competency, US prosecutors say

Thomas V. Girardi’s behavior in court and in clinical evaluations is enough to prove he can process events as they happen and aid in his defense, the Department of Justice said in a document that used his sotto voce expletive against a government attorney as evidence of his competency to stand trial.
