Circuit vacates denial of class for Fresno women’s team

The decision does not dispose of the class certification issue. The Eastern District of California court has not ruled on the propriety of the class definitions presented, the adequacy of class counsel, and whether plaintiffs satisfy Rule 23(b) (2) of the Federal Rules of Civil Procedure.

The 9th U.S. Circuit Court of Appeals on Wednesday vacated a district judge’s denial of class certification for six former members of the women’s lacrosse team at Fresno State. The decision allows the Title IX case to proceed as a potential class action.
