It’s time to split the Ninth Circuit

The recent Ninth Circuit decision in Johnson v. City of Grants Pass underscores the difficulty of developing a true Ninth Circuit-wide decision, even in cases of unquestionable importance.

Already large and unwieldy, the Ninth Circuit Court of Appeals, one of 11 regional circuit courts, has over 50% more judges than any other circuit court, 40% of the territory of the U.S. (covering the entire Western United States), and 20% of our nation’s population.
