Got standing? US agency says former student does not in school-related milk case

The US Dept. of Agriculture contends former Los Angeles student lacks standing to challenge statute prohibiting school lunch program participants from criticizing dairy.

On Tues., Jan. 23, the United States Department of Agriculture argued that a former Los Angeles student lacked standing to sue the USDA regarding a statute that she alleges violates her First Amendment rights. The statute prohibits school lunch program participants from "directly or indirectly restrict[ing] the sale or marketing of fluid milk products." 42 U.S.C. § 1758(a)(2)(C).
