On Tues., Jan. 23, the United States Department of Agriculture argued that a former Los Angeles student lacked standing to sue the USDA regarding a statute that she alleges violates her First Amendment rights. The statute prohibits school lunch program participants from "directly or indirectly restrict[ing] the sale or marketing of fluid milk products." 42 U.S.C. § 1758(a)(2)(C).
