Shock Doctor says demurrer will end case, asks discovery stay
"I know all defense counsel thinks their demurrer is dispositive but if it is then it ends the case and we don't need to go through unnecessary discovery," Scott S. Humphreys of Ballard Sphar LLP said.
Attorneys for Shock Doctor Inc., one of the leading producers of sports mouthguards, told a Santa Clara County judge Wednesday that they intend to file a demurrer to a putative class action accusing the company of falsely advertising a dental warranty of up to $50,000.
