Masimo wants to proceed with patent claims against Apple

Knobbe Martens Olson & Bear LLP partner Adam B. Powell argued Apple seeks to unnecessarily further delay Masimo’s patent claims for a “tactical advantage” for a trade secrets case that’s in its fourth year.

After Apple Inc.’s unsuccessful challenge in the U.S. Court of Appeals for the Federal Circuit, its opponent in a pulse oximetry patent infringement case, Masimo Corporation, said the time had come to unpause its claims and move the case forward.

Oral arguments on whether the stay will be lifted will be heard Feb. 26 before U.S. District Judge James V. Selna in Santa Ana.
