Breach of contract claim against state in PPE case dismissed
The company said state officials gave preferential treatment to other businesses that missed deliveries of medical supplies from China during the COVID-19 outbreak.
A Sacramento County judge tentatively dismissed a breach of contract claim brought by a provider of personal protective equipment against the state of California. The case is one of many that grew out of contracts signed during the frantic early days of the COVID-19 pandemic.
In the tentative ruling issued Tuesday, Superior Court Judge Thadd A. Blizzard dismissed Bear Mountain Development Company’s complaint without leave to amend.
