A cannabis business owner who sued after the city of Sacamento denied him a license because he doesn’t live there should be able to bring his claims in federal court, a 9th U.S. Circuit Court of Appeals panel ruled Monday.
The city argued the dispute belonged in state court, but the 9th Circuit panel ruled the dispute, which implicates the dormant commerce clause, belongs in federal court.
