A 9th U.S. Circuit Court of Appeals panel next week will consider prosecutors' bid to revive criminal charges against white supremacists accused of using interstate commerce with intent to riot at rallies in three California cities, a rare but not extraordinary example of a judge dismissing criminal charges due to selective prosecution.
