Judge likely to allow neurologist to testify in Girardi fraud trial

Prosecutors had argued that evidence as to Girardi's current mental state could improperly lead the jury to infer that he wasn't capable of forming the intent to defraud his clients in the past.

Testimony from a doctor who argued unsuccessfully that disbarred attorney Thomas V. Girardi is incompetent will be allowed in his upcoming wire fraud trial despite prosecutors' attempt to exclude it, a U.S. District Court judge tentatively ruled on Thursday.
