Apple's doctor expert scrutinized in Masimo's patent case

Parties disagree on whether the work of Dr. Patrick Mercier - a co-director for the Center of Wearable Sensors at the University of California San Diego - poses a commercial threat to Masimo.

Attorneys involved in Masimo Corp. and Apple Inc.'s pulse oximetry patent infringement and trade secrets case are debating whether Apple's proposed doctor expert poses a competitive threat to Masimo's heart sensory technology and should be prevented from seeing certain confidential materials during the expert discovery phase of the case.
