Covington & Burling LLP | San Francisco

Winner obtained a favorable result for client Wells Fargo Bank NA before the 11th U.S. Circuit Court of Appeals.

The Covington & Burling partner is representing the bank in complex consumer claims alleging that Wells Fargo and predecessor Wachovia Bank NA unlawfully charged overdraft fees on debit card transactions.

Winner convinced the appellate court to vacate a district judge's order finding that Wells Fargo had waived its right to enter arbitration with putative members of multiple class actions. Spears-Haymond v. Wells Fargo Bank NA, 13-12082 (11th Cir., Feb. 10, 2015).

She is also representing Wells Fargo in the Southern District of Florida, where the case is ongoing.

"This is a very complex piece of litigation, not just with the arbitration issue, but also the class action issues and the underlying legal issues," Winner said. "You have to have a good long-term strategy."

Winner also enjoys mentoring lawyers in volunteer matters. She frequently works with the Family Violence Appellate Project in Oakland to assist victims of domestic violence.
