A Los Angeles County Superior Court judge on Thursday threw out the conviction of 53-year-old Kash Delano Register, who was wrongfully convicted of first-degree murder in 1979.
Loyola Law School's Project for the Innocent helped lead the effort to overturn Register's conviction. The team of lawyers and law students argued that the prosecution's failure to disclose exculpatory evidence and the use of false testimony at trial amounted to a due process violation. Judge Katherine Mader heard the case.
Register, who was 18 when he was arrested, spent 34 years in state prison. An African-American, he was convicted by an all-white jury in the robbery-homicide of an elderly white man in the Pico Robertson neighborhood of Los Angeles.
"We could not be happier for our client, a person of amazing strength and moral conviction who has steadfastly maintained his innocence for almost three and a half decades," Lara Bazelon, director of the Project for the Innocent, said in a statement.
Register was expected to be released from custody late Friday.
