President Donald J. Trump named Emanuel in late June to fill the National Labor Relations Board’s fifth and final member spot on the board tasked with judging compliance with the National Labor Relations Act, especially the ability of workers to join unions and other collective actions.

“It is an honor to be nominated by the president for this important position, and I would be privileged to serve if the Senate confirms my nomination,” Emanuel said in a statement.

The veteran management-side attorney has extensive experience representing employers in traditional labor matters, such as collective bargaining negotiations, administration of collective bargaining agreements, labor arbitration and union election campaigns.

He has particular expertise with laws that concern union access to the private property of employers under federal laws such as the Norris-LaGuardia Act and National Labor Relations Act and state laws involving trespassing and constitutional rights.

Emanuel has authored amicus curiae briefs on behalf of trade associations in cases that challenge state laws allowing labor unions to trespass on the private property of employers.

Emanuel also advises employers regarding business reconstructing decisions such as mergers and acquisitions, plant closings, workforce reductions, separation agreements and Worker Adjustment and Retraining Notification Act, or WARN, notices.

He works with a wide range of clients, including hospitals and other health care institutions, trade associations, school districts, manufacturing companies, as well as transportation and logistics companies.

Emanuel is a member of Littler’s traditional labor practice group and an editor of labor publications.
