Paul Hastings LLP | San Francisco

House, a San Francisco-based partner with Paul Hastings LLP, is co-counsel in an ongoing antitrust complaint for client Cave Consulting Group Inc. against rival OptumInsight Inc. over the defendant asserting patents allegedly obtained through inequitable conduct.

The lawsuit was filed in July 2015 after Cave Consulting defeated an OptumInsight infringement claim when a jury concluded Cave did not infringe an OptumInsight patent.

The antitrust lawsuit was recently referred to mediation by Chief Magistrate Judge Joseph Spero of the Northern District of California. Cave Consulting Inc. v. OptumInsight Inc., 15-CV3424 (N.D. Cal., filed July 24, 2015).

House previously helped to represent Oracle Corp. in a lawsuit against SAP AG and TomorrowNow for improper infringement and misuse of the Redwood Shores company's proprietary service and support software. The company won a $1.3 billion award.

"That was huge. This was the largest jury verdict of 2010, and the largest copyright verdict ever," House said.

The case settled in November 2014 for $359.1 million after the 9th U.S. Circuit Court of Appeals rejected Oracle's bid to keep the higher award. Oracle USA Inc. et al. v. SAP AG et al., 07-CV1658 (N.D. Cal., filed Mar. 22, 2007).
