Brian is lead trial counsel for Bank of America defending against breach of contract claims brought by a group of mezzanine lenders seeking more than $1 billion in damages. Avenue CLO Fund Ltd., et al, v. Bank of America N.A., et al, 2:09-cv-01047-KJD-PAL (D-Nev., filed June 9, 2009).


He also is representing LG Display in upcoming trials in a variety of states against major retailers alleging price-fixing among manufacturers of display panels.


And he continues to represent Transocean Ltd. through the multidistrict litigation stemming from the 2010 BP oil spill in the Gulf of Mexico.


In 2013, that included three months of trial in New Orleans.


When trying case outside California, Brian said he has a firm protocol.


"The first thing I do is to introduce myself to the court clerk, the bailiff and the court reporter," he said. "It's really important to come across as humble. Judges talk to their staffs, so I try to make sure that I am not perceived as an arrogant out-of-town lawyer who should be treated specially."


A seasoned litigator, Brian said that he loves trying cases.


"Most don't get to trial, but, on average, I've been able to get at least one or, sometimes, two big cases to trial every year or so over the last 10 to 12 years," he said.


Brian often gets brought into a case late in the game, after discovery has been concluded.


"It's a good thing I have this reputation for being able to get up to speed relatively quickly," he said.
