White collar criminal defense

Topel represented two high-profile white-collar criminal defendants in San Francisco last year. In the first case, he defended the founder and former chief executive of Brisbane-based biopharmaceutical company InterMune Inc. on two counts related to off-label drug marketing. Last September, a jury acquitted Dr. Scott Harkonen of one count but convicted him on a wire fraud charge for sending false information about a drug in a press release. In the second trial, defending former McKesson Corp. attorney Jay M. Lapine, Topel was victorious. Lapine was originally tried in 2006 when a jury failed to a reach a verdict on most of the charges. After the retrial last fall, a jury returned a complete verdict of acquittal for Lapine.
