Barkan has handled more than three dozen software patent cases during his litigation career. In 2008, he won a major victory representing two flash memory clients, Kingston Technology and Phison Electronics Corp., against an International Trade Commission action filed by SanDisk Corp. Barkan knocked out all but one of the patents allegedly infringed before the ITC proceedings started. He then got a stipulation on the remaining disputed patent, guaranteeing that his clients would be able to sell their products regardless of the trial's outcome. His victory came two years after Barkan completed a lengthy stint as Fish & Richardson's nationwide head of litigation.
