He got off to a promising start, bringing his signature wit and flair to the leadership of a stodgy bench. He penned major opinions green-lighting a bias suit against Roommates.com and allowing judges to question the No Fly List, sometimes called the terrorist watch list, a secret list created and maintained by the U.S. government of people who are not permitted to board a commercial aircraft for travel within the country. But his major innovation - posting judicial misconduct orders online - ironically bit back when lewd photos were discovered on his Web site, alex.kozinski.com, and he was forced to seek an investigation into his own behavior. No big deal, maybe, but the revelation led to a mistrial in a major federal pornography prosecution.
