He continues to be the standard bearer for a more generous view of fair use online, waging battles against old media giants on behalf of a more expansive view of copyright law. Working with Keker & Van Nest, he persuaded a Los Angeles judge to reject Universal Music Groups bid to block client Troy Augusto from selling promotional CDs he got from music shops and online auctions on eBay, even though they were labeled Not for Resale. The judge ruled in June that the label does not trump Augustos right to sell CDs he acquired. The ruling is now on appeal before the 9th U.S. Circuit Court of Appeals.
