Esha Bandyopadhyay

Bandyopadhyay was introduced to intellectual property law during her second year at UC Berkeley School of Law in a class taught by professor turned friend Mark A. Lemley.

“I took his class and I loved it,” said Bandyopadhyay. “I loved all four aspects of it – patents, trade secrets, trademarks and copyrights – and I knew that’s what I would do.”

Today, her practice is primarily focused on patent and trade secret litigation, advising plaintiffs and defendants as well as helping clients avoid litigation.

Her work crosses various technology sectors from power circuits to engineered architecture along with pharmaceutical compounds and medical devices.

Bandyopadhyay is focusing on an ongoing trade secret litigation case related to technology use for the creation of automated audio advertisements. She and a team of Fish attorneys are representing the plaintiff, VoxTonePRO, in litigation against Spotify that alleges the defendant used trade secret information, which was shared during conversations on a potential partnership, to develop competing technology. The case is in the early motion practice stage and is expected to go to trial in 2022. Mujae Group Inc. v. Spotify USA Inc. et al., 1:2020-cv-00596 (District of Delaware, April 30, 2020)

Outside of her practice, she is an active member of the Silicon Valley Intellectual Property Law Association, the Women’s Intellectual Property Lawyers Association, the National Asian Pacific American Bar Association, the South Asian Bar Association and ChIPS. She serves on the board of directors of Legal Momentum and is the founder and chair of the American Indian Foundation’s Bay Area Circle of Hope. Additionally, she will be teaching a trade secret course at UC Davis School of Law in the spring of 2021.
