Kaba is enthusiastic to be back in the courtroom. He has recently scored wins for Caltech in a false claims case, for Amazon.com over eBay Inc. and has attained a $10 million settlement for the Navajo Nation over a massive toxic mine waste spill in Colorado.

He served as co-lead counsel in just completed and pending trials, representing PricewaterhouseCoopers over federal contract and retaliation claims and Endo Pharmaceuticals Inc. in opioid litigation.

In April 2021, U.S. District Judge Christina A. Snyder of Los Angeles granted summary judgment to Caltech and three of its professors in a suit by a fourth teacher who alleged fraud against the U.S. Department of Energy and retaliation. U.S. v. Caltech et al., 2:18-cv-05964 (C.D. Cal., filed July 9, 2018).

In January 2021, Hueston Hennigan’s Navajo Nation client settled for $10 million claims against two gold mining corporations for their role in the 2015 Gold King Mine blowout in Colorado that released millions of gallons of toxic waste into waters upstream of the Nation. Claims against the U.S. Environmental Protection Agency and other government defendants remain pending. In re: Gold King Mine Release in San Juan County, Colorado, 1:18-md-02824 (D. New Mexico, filed April 4, 2018).

In December 2020, an arbitration panel granted client Amazon.com a complete defense verdict after rival eBay sued over claims of seller poaching. eBay Inc. v. Amazon.com Inc.,18-cv-336315 (S. Clara Co. Super. Ct., filed Oct. 17, 2018).

On July 26, 2021, Kaba and co-counsel obtained a complete defense victory for PricewaterhouseCoopers following a bench trial on wrongful termination claims by a former senior manager. A magistrate judge found the manager, Mauro Botta, had failed to prove his case. Botta v. PricewaterhouseCoopers LLC, 18-cv-02615 (N.D. Cal., filed May 3, 2018).

And Kaba had rested the defense for Endo Pharmaceuticals in litigation in California’s case against drug-makers for allegedly having helped create the opioid epidemic. People v. Purdue Pharma et al., 14000725287 (Orange Co. Super. Ct., filed May 21, 2014).

“It was a challenging case, but we thought we had a strong defense,” Kaba said. “It was my third trial in the last 12 months, with four or five to come. It’s been great. Nothing gets that fire going better than getting into the courtroom.”
