• AB 396 (Gabriel) Requires the California Department of Social Services (CDSS) to issue a guidance letter on the eligibility requirements for a campus-based program to become a local educational program that increases employability for the purpose of qualifying students for CalFresh; requires qualifying campus-based programs of the California Community Colleges (CCC) and the California State University (CSU), and requests qualifying campus-based programs of the University of California (UC), to apply to become local education programs that increase employability by September 1, 2022; and requires CDSS to issue a report annually, until 2030, regarding the progress of approving campus-based local education programs that increase employability, as specified. act to add Section 18901.12 to the Welfare and Institutions Code, relating to CalFresh.

• AB 445 (Calderon) Removes the requirement that certain information is collected by a regional center for each new case and is also collected at each review of all regional center clients in out-of-home placement. act to amend Section 4657 of the Welfare and Institutions Code, relating to developmental services.

• AB 461 (Villapudua) Specifies the factors used to calculate the number of welfare-to-work (WTW) hours a California Work Opportunity and Responsibility to Kids (CalWORKs) participant is engaging in self-employment activities. act to add Section 11322.82 to the Welfare and Institutions Code, relating to CalWORKs.

• AB 477 (Blanca Rubio) Provides that if a county utilizes a child advocacy center to implement their local multidisciplinary response to investigate reports of child abuse or neglect, the child advocacy center must be included in the county child abuse multidisciplinary personnel team (MDT) and makes technical changes. act to amend Section 18961.7 of the Welfare and Institutions Code, relating to child abuse.

• AB 592 (Friedman) Deletes the requirement that a host family be certified by a transitional housing placement (THP) provider; expands the scope of a host family to include supervised transitional housing services; permits a host family to include certain approved placements and declares that those placements, when operating as a host family, do not require additional certification; expands the definition of a Supervised Independent Living Setting (SILS) to include a transitional housing unit in which a host family lives with a nonminor dependent (NMD) participating in a THP program in certain settings; and, permits a county to elect to authorize a licensed THP provider to offer supportive services to assist an NMD in their SILS, as specified. act to amend Sections 1506 and 1559.110 of the Health and Safety Code, and to amend Sections 11400 and 11402.2 of the Welfare and Institutions Code, relating to foster youth.

• AB 636 (Maienschein) Would authorize information relevant to the incident of elder or dependent adult abuse to be given to a federal law enforcement agency charged with the investigation of elder or dependent adult abuse. Would authorize information relevant to the incident of elder or dependent adult abuse to be given to a local code enforcement agency for the sole purpose of investigating a property where the health and safety of an elder or dependent adult resident is at risk. act to amend Section 15633.5 of the Welfare and Institutions Code, relating to elder and dependent adult abuse.

• AB 638 (Quirk-Silva) Revises the Mental Health Services Act (MHSA) by authorizing the use of Prevention and Early Intervention (PEI) funds for prevention and early intervention strategies that address mental health needs, substance misuse or substance use disorders (SUDs), or needs relating to co-occurring mental health substance use. act to amend Section 5840 of the Welfare and Institutions Code, relating to mental health, and making an appropriation therefor.

• AB 640 (Cooley) Permits a county to petition the juvenile court on behalf of certain non-minor dependents (NMDs) to terminate dependency or transition jurisdiction over the youth and immediately re-establish jurisdiction in order to establish the NMD’s eligibility for federal financial participation; expands the definition of a voluntary re-entry agreement to include an agreement between a NMD who has not signed a voluntary re-entry agreement after attaining 18 years of age and for whom a petition to terminate jurisdiction will be filed. act to amend Sections 388, 11400, and 11401 of the Welfare and Institutions Code, relating to foster youth.

• AB 670 (Calderon) Requires, when a report alleging abuse or neglect of the child of a dependent of the juvenile court is made, the agency that received the report to notify the attorney representing the dependent within 36 hours; prohibits the court from declining to offer reunification services in certain instances where a minor or non-minor dependent (NMD) parent is involved; and, requires a social worker or probation officer to use a strengths-based approach to supporting a minor or NMD parent in providing a safe and permanent home for their child. act to amend Section 11166.1 of the Penal Code, and to amend Sections 361.5 and 361.8 of the Welfare and Institutions Code, relating to child abuse or neglect.

• AB 674 (Bennett) Expands the list of information, documents, and services that a county welfare department, at the last review hearing prior to that youth’s 18th birthday, must report to the court on its progress in providing to the youth written information notifying the minor or nonminor that they may be eligible to receive, and where they may apply for, CalFresh benefits. act to amend Section 391 of the Welfare and Institutions Code, relating to juveniles.

• AB 788 (Calderon) Clarifies the meaning of “resisted” within current provisions that enable a juvenile dependency court to deny reunification services for a parent with a history of drug or alcohol abuse. act to amend Section 361.5 of the Welfare and Institutions Code, relating to juveniles.

• AB 829 (Levine) Requires a county to make best efforts to provide undocumented minors and non-minor dependents (NMDs) in foster care under the jurisdiction of the juvenile court with access to immigration legal services; additionally requires counties to submit reports to the California Department of Social Services (CDSS) regarding the process of identifying and meeting the needs of undocumented youth in their county, as specified. act to amend Section 2104.1 of the Probate Code, and to amend Section 16010.6 of, and to add Section 13310 to, the Welfare and Institutions Code, relating to foster children.

• AB 873 (Ramos) Requires, upon the request of a tribe, the California Department of Social Services (CDSS) to enter into an agreement with a tribe, tribal organization, or tribal consortium regarding the care and custody of Indian children. Additionally, eliminates the tribal share of cost requirements for such agreements, as specified. act to amend Section 10553.1 of, and to repeal Section 10553.11 of, the Welfare and Institutions Code, relating to public social services.

• AB 977 (Gabriel) This bill requires grantees or entities that receive funding from a state homeless program or programs to report specified data to the Homeless Coordinating and Financing Council (HCFC) on the populations they serve. act to amend Sections 8256 and 8257 of the Welfare and Institutions Code, relating to homelessness.

• AB 1004 (Calderon) This bill deletes requirements that, in order to be exempt from being considered income under the CalWORKs program, income or stipends related to the decennial census must be earned on the year of or year prior to a census, so that all such income or stipends may be exempted, regardless of when it is earned, and makes those changes effective immediately. act to amend Section 11157 of the Welfare and Institutions Code, relating to CalWORKs, and declaring the urgency thereof, to take effect immediately.

• AB 1140 (Robert Rivas) Specifies that children who are placed in residential facilities and homes by the Office of Refugee Resettlement (ORR) of the federal Department of Health and Human Services are included among those who the Office of the State Foster Care Ombudsperson is responsible for, among other things, investigating and attempting to resolve complaints; additionally, specifies that residential facilities and foster homes for children in the custody of the ORR of the federal Department of Health and Human Services are included among those facilities who the California Department of Social Services (CDSS) is required to ensure that accord children and nonminor dependents (NMDs) in foster care their personal rights. act to amend Section 1530.91 of the Health and Safety Code, and to amend Section 16164 of the Welfare and Institutions Code, relating to foster care.

• AB 1220 (Luz Rivas) This bill renames the Homeless Coordinating and Financing Council (HCFC) as the Interagency Council on Homelessness (ICH), reconstitutes its membership, and requires it to consult with a specified advisory group of stakeholders. act to amend Sections 50210 and 50216 of the Health and Safety Code, and to amend Sections 8255, 8256, 8257, and 8260 of the Welfare and Institutions Code, relating to state government.

• AB 1243 (Blanca Rubio) Effective January 1, 2023, allows, after notice and a hearing, an interested party to seek a protective order for isolation of an elder or dependent adult under the Elder Abuse and Dependent Adult Civil Protection Act (EADACPA) and for the court to make a finding that specific debt was incurred as the result of financial abuse of the elder or dependent adult. act to amend, repeal, and add Section 15657.03 of the Welfare and Institutions Code, relating to protective orders.

• AB 1283 (Stone) Adopts changes to further facilitate implementation of Continuum of Care Reform (CCR) specifically as it relates to criminal background checks for tribally approved homes (TAH), the appeals process for resource family applicants, and temporary exclusions from community care facilities. act to amend Section 11105.08 of the Penal Code, and to amend Sections 10553.12, 11461, 11461.36, 11462, 16519.6, and 18358.30 of the Welfare and Institutions Code, relating to foster care.

• AB 1294 (Quirk) Extends the sunset for the individualized county childcare subsidy plan pilot projects for Santa Clara County. act to amend Section 8281 of, and to add and repeal Section 8282.6 of, the Education Code, and to amend Section 10348 of the Welfare and Institutions Code, relating to childcare, and declaring the urgency thereof, to take effect immediately.

• AB 1443 (McCarty) Permits any county to develop training and procedures related to taking, or causing to be taken, a person into custody for an involuntary detention, as specified. Requires the County of Sacramento to develop a written policy for training and procedures for designating persons who are employed by the City of Sacramento and who meet specified criteria to involuntarily detain individuals. act to amend Sections 5121 and 5154 of the Welfare and Institutions Code, relating to mental health.

• SB 86 (Committee on Budget and Fiscal Review) This bill provides for statutory cleanup necessary to implement the Golden State Grant Program and other changes to help implement COVID-19 supports in safety net programs. act to amend Sections 8151, 8152, 10004, 10850, and 11461.36 of, and to add Section 12201.7 to, the Welfare and Institutions Code, relating to public social services, and making an appropriation therefor, to take effect immediately, bill related to the budget.

• SB 168 (Committee on Budget and Fiscal Review) This bill makes clarifying changes and technical corrections associated with changes to child care and development program adopted as part of the Budget Act of 2021. act to amend Section 10213.5 of the Welfare and Institutions Code, to amend Section 3 of Chapter 6 of the Statutes of 2021, to amend Section 263 of Chapter 116 of the Statutes of 2021, relating to child care, and making an appropriation therefor, to take effect immediately, bill related to the budget.

• SB 258 (Laird) This bill adds human immunodeficiency virus (HIV) status to the list of noneconomic factors that determine “greatest social need” for services under the Older Californians Act (OCA). act to amend Section 9015 of the Welfare and Institutions Code, relating to aging.

• SB 354 (Skinner) This bill adopts changes to the criminal background check process during the resource family approval (RFA) process for relatives of children placed in the child welfare system; permits the court to authorize placement of children with relatives in certain circumstances, regardless of the status of any criminal exemption or RFA; and, requires, no later than January 1, 2024, the California Department of Social Services (CDSS) to submit a report to the Legislature related to criminal record exemptions as specified. act to amend Sections 1522, 1568.09, 1569.17, and 1596.871, and to add and repeal Section 1521.7 of, the Health and Safety Code, and to amend Sections 309, 319, 361.2, 361.4, 727.05, 11461.3, 11461.36, and 16519.5 of the Welfare and Institutions Code, relating to public social services.

• SB 393 (Hurtado) This bill aligns the funding structure for the migrant childcare alternative payment program (voucher) with other voucher programs by shifting the reimbursement rate for migrant childcare alternative payment programs from the Standard Reimbursement Rate to the Regional Market Rate. This bill also expands reimbursement allowances to include additional costs. act to add Section 10229.4 to the Welfare and Institution Code, relating to public social services.

• SB 465 (Eggman) This bill requires the Mental Health Services Oversight and Accountability Commission to report biennially to the Legislature specified information about services and outcomes for those receiving Mental Health Services Act-funded Full-Service Partnership (FSP) services. act to add Section 5845.8 to the Welfare and Institutions Code, relating to mental health.

• SB 497 (Limón) This bill revises the definition of qualifying accounts that can receive direct deposits related to unemployment compensation, child support, and other public assistance payments and requires the Employment Development Department to additionally provide direct deposit options for recipients of disability or family temporary disability insurance benefits, as specified. act to amend Section 17325 of the Family Code, to amend Sections 1339.1 and 2701 of the Unemployment Insurance Code, and to amend Section 11006.2 of the Welfare and Institutions Code, relating to direct deposit of funds.

• SB 507 (Eggman) This bill broadens criteria to permit assisted outpatient treatment (AOT) for a person who is in need of AOT services, as specified, without also requiring the person’s condition to be substantially deteriorating. This bill permits specified individuals to testify at a court hearing via videoconferencing, as specified. This bill permits a court to order AOT for eligible conservatees, as specified, when certain criteria are met. act to amend Section 5346 of, and to add Section 5346.5 to, the Welfare and Institutions Code, relating to mental health.

• SB 578 (Jones) This bill clarifies an existing statute that makes proceedings under the Lanterman-Petris Short (LPS) Act presumptively nonpublic. act to amend Section 5118 of the Welfare and Institutions Code, relating to mental health.

• SB 584 (Jones) This bill expands existing mandatory training for resource families and resource family applicants to include information on providing care and supervision to children who have been victims of child labor trafficking, as specified. act to amend Section 16519.5 of the Welfare and Institutions Code, relating to foster care.

• SB 609 (Hurtado) This bill requires the California Department of Social Services (CDSS), to the extent permitted by federal law, to include adult education and career technical education programs in the list of programs deemed to meet the student exemptions for purpose of eligibility for CalFresh benefits.An act to amend Section 18901.11 of the Welfare and Institutions Code, relating to CalFresh.
