Caixeiro walks alongside industry leaders and innovative companies in their most challenging intellectual property litigation matters.
He finds those cases to be exciting because “esports, influencers and tech is an area of undefined law. It’s like litigating in the Wild West and that’s what we do. We’re setting precedents that will be followed in other similar cases.”
His work in patent damages disputes, valuation and licensing includes industries such as software, medical devices, internet of things, financial services and entertainment.
Caixeiro repeats a mantra while talking about his practice: “patent litigation is not a technical problem, it’s a business and technology problem.”
His clients include Starz Entertainment, John Crane, Inc., esports team FaZe Clan Inc. and Open Text, Inc.
Caixeiro describes his litigation style as looking at finance and damages aspects. “We take our time to try to establish how much a patent is worth to create a record that supports our damages case.”
He spoke of his trial by fire as a defendant for Endurance Lift Solutions: litigating intellectual property with recently appointed U.S. District Judge Alan Albright in Texas. “He is now litigating one of every five patent cases in the U.S.,” he said.
“The whole patent world was watching,” Caixeiro continued. “There were people from other cases sitting in the gallery who wanted to understand how he would approach issues, and we were on the tip of that spear.”
The case was a patent litigation concerning technology used in oil drilling, where Manny achieved an exclusion of the plaintiff’s damages expert opinion. That decision was affirmed on appeal, and a confidential settlement was subsequently entered. Finalrod IP, LLC v. Endurance Lift Solutions, Inc 2:20-cv-00189- JRG-RSP (E.D. Texas filed Dec. 12, 2020).
“Without the expert, there was no damage case, so the other side just gave up,” he said. Since then, “the case was settled without need of a trial. Although it was appealed, the Federal Circuit only had one question for Judge Albright and when it got back down, it was settled”.
Caixeiro’s team also included Timothy Carroll, Margaret K. Ukwu and Laura Wytsma.
Caixeiro frequently works with his clients to analyze the strength and value of patent portfolios, enabling clients to maximize their returns in transactions, obtain more accurate litigation assessments and budgets and avoid undue expenses and inefficiencies.
He also serves as a member of the board of directors of the Constitutional Rights Foundation, a nonprofit that works with high school-aged children-in the Los Angeles area and elsewhere-to educate them about democracy, including a mock trial program. He has also participated in multiple mock trials as a judge or other supervisor.
