Edward R. Reines, a partner at Weil Gotshal & Manges LLP, has been with the firm for 30 years, helping it build the first Silicon Valley office in the country for a national firm. He specializes in technology litigation, especially inventions and patents, and recently has been working mostly in the life sciences and genomics industries.
Recently, Reines bolstered his growing list of victories by achieving one of the largest ever false advertising jury verdicts in CareDx Inc. v. Natera Inc., 1:19-cv-00662, (D. Del., filed April 10, 2019). The $45 million Lanham Act verdict, which found almost all of the challenged statements Natera made were deliberately false and almost all of CareDx’s advertising statements were truthful, resulted in a net $700 million change in both companies’ market caps the next day.
Another recent triumph Reines is proud of is Bio-Rad Laboratories Inc. et al v. 10X Genomics Inc., 1:15-cv-00152, (D. Del., filed Feb. 12, 2015). 10X allegedly developed and sold a product that infringed on Bio-Rad’s genetic analysis patents, and Reines led a team of attorneys to attain a settlement agreement in which 10X must pay royalties to Bio-Rad through 2030. So far 10X has paid Bio-Rad more than $60 million. Reines also secured a permanent injunction barring almost all of 10X’s products from being sold as well as a $24 million jury verdict.
Reines believes one important factor behind litigation success is putting together a team that fits well. “I view litigation teams as mosaics,” he said in an interview. “You’re never going to find everyone that’s well-rounded. Each person is an individual and you have to take advantage of strengths. The whole is greater than the sum of its parts.”
Reines said he’s been with his firm for 30 years because it is incredibly supportive of teamwork and that is a critical part of its success.
