Frank N. Darras is a partner and founder at DarrasLaw and has gained recognition due to his extensive experience in handling individual and group ERISA bad faith long-term disability insurance cases.

Throughout his career, he and his team of long-term disability attorneys have successfully litigated and resolved numerous cases involving delays, denials and terminations of long-term disability insurance.

“Last year was like most others as we delivered nearly 600 victories to our clients in a variety of categories,” Darras said in an email. “We overturned wrongful denials for our group ERISA clients who got their disability coverage through work and now have their monthly benefits reinstated. We also pre-suit negotiate with many individual disability insurers, having filed thousands of cases over the years. Our firm is known for bringing the best supporting treating doctors, every type of objective testing including functional capacity exams that test physicality and stamina and neuro psyche testing to document cognitive problems.”

Often, he added, he and his firm can let carriers know they represent an insured and resolve their differences without filing a complaint.

“This past year we litigated and resolved confidentially all our nationally filed cases without going to summary judgment or trial, enabling our clients to get the money they had been denied, quicker and with a less expensive fight, while getting the last nickel they deserved,” Darras said.

Another significant challenge last year was trying to prove long-COVID clients were truly disabled.

“Often times a carrier would use their tried-and-true denial strategy like videoing our clients for days in a row to see if they left the house, could they bend, stoop, push, pull or carry while shopping and since they occasionally drove how could they be cognitively impaired,” Darras said. “CT testing to show scarred lungs post hospitalization, pulmonary function tests, all day neuro psychological testing to evaluate and document slow executive functioning and poor sustained attention were expensive but crucial in convincing Disability insurers our clients were unable to do the important duties of their former occupations.”

Darras is associated with various legal organizations, including the Ten Million Dollar Rainmaker Circle, Leaders in The Law, and the Insurance Bad Faith Trial Lawyers Association. These associations highlight his professional standing and involvement within the legal community.
