IP Litigation
Manny J. Caixeiro's practice consists of complex commercial and intellectual property disputes across a range of industries, including entertainment, Internet of Things, financial services, software and medical devices.
Though he has litigated in a variety of fields from both sides of the courtroom, he says his passion for technology is what helps motivate him to continually defend companies and help everyone involved get a better understanding of the science behind the software.
"What I love about IP litigation is every case brings a new technology, problem and concept that I never considered before," he said. "I'm not someone who has an engineering or science degree, but what I hope to have and what I hope to bring to the table is an ability to connect with judges, juries and people to help them understand these complex scientific concepts ... if I can do that, I'm doing a great service for my clients."
This mindset has earned Caixeiro nearly two decades of wins, as he is continually sought after by industry leaders and cutting-edge companies to litigate their most challenging disputes. Some of his clients include Starz Entertainment, Sony Pictures, Open Text, Inc. and Ecobee, Inc.
Over the past three years, Caixeiro obtained non-infringement and invalidity verdicts for Ecobee, Inc., a smart home automation company most known for smart thermostats, in a number of trials nationwide concerning alleged infringement of a variety of patents related to artificial intelligence, energy management and efficiency and networking.
He is currently involved in a number of matters representing different entertainment companies that face similar assertions in the streaming market. "Streaming services have really exploded in the last five to seven years, which has given me the opportunity to work with a lot of really cool companies," he said.
However, this explosion creates what Caixeiro refers to as an "expensive" and "frustrating" business problem for the streaming companies to continually have to deal with. "That business problem is that there's a whole industry that's arisen whose job it is to acquire patents and finance lawsuits against streaming entities."
He recently defended Starz Entertainment against allegations that its streaming service infringed standard essential patents relating to streaming technologies, including complex damages issues relating to Fair, Reasonable and Non-Discriminatory licensing obligations. Helios Streaming, LLC v. Starz Entertainment, 19-cv-2140 (C.D. Cal., filed Nov. 6, 2019).
He is currently counseling Sony Pictures Entertainment in connection with intellectual property issues.
