This lawsuit resulted in a settlement providing vouchers to affected class members and marked the first litigation to address benzene contamination in aerosol products. Grombacher highlighted the challenges of dealing with regulatory agencies like the FDA in such cases, emphasizing the importance of advocating for vulnerable clients quickly and efficiently.
"In re Johnson & Johnson ... is significant because it was the first litigation to address industrywide benzene contamination in aerosol products. The case set the standard for a flurry of cases that followed," said Grombacher.
Another noteworthy case led by Grombacher is a class-action lawsuit filed on behalf of Apple users against Meta Platforms, the parent company of Facebook and Instagram. Larch-Miller v. Meta Platforms Inc., 3:22-cv-05426 (N.D. Cal., filed Sept. 22, 2022).
The suit alleges that Meta continued to track iPhone users' activity even after they had opted out, violating privacy laws and wiretap acts. The litigation underscores Meta's unauthorized access to users' personal information and reflects a growing trend of privacy cases in the class action field.
"There has been a proliferation of privacy cases in the class action field. I think lawyers need to start litigating issues related to the CCPA to make sure we are maximizing recovery for injured consumers who are fortunate enough to have statutes such as that which provided added protection," Grombacher said.
