A partner at Larson LLP, Hilary Potashner's career spans 30 years, including being twice appointed as the former federal defender for the Central District of California.

Since joining the firm in 2019, she has successfully handled many of the firm's top white-collar defenses and investigations. Her deep familiarity with state, federal and appellate courts has been a significant advantage for her clients.

In one recent case, Potashner represents clients in USA v. Tammy Le et al., a case involving allegations of wire fraud for $12 million, identity theft, money laundering and criminal forfeiture.

"We recently negotiated a non-prosecution agreement for a high-level administrator who was being investigated for a serious reporting violation. This resolution was reached after we conducted a thorough investigation into the facts and applicable law, forming the basis of our presentation to the prosecutor overseeing the matter," Potashner said. "I think cases like this are significant to white-collar defense because they demonstrate the importance of an in-depth independent examination of the facts, a comprehensive understanding of the relevant law, and an open line of respectful communication with opposing counsel. When proactive and skillful preparation is coupled with persuasive advocacy and professionalism, there is an increased chance of a just and fair outcome. I am particularly proud of this case because that is exactly what happened here -- a just and fair outcome."

Another of her notable contributions includes leading an investigation into the treatment of the 13 Turpin children while under the care of Riverside County, resulting in statewide policy changes in California.

Potashner and partner Stephen Larson were retained to investigate allegations regarding the Riverside County Foster Care and Dependent Adult Services, particularly the care of the Turpin children after their rescue in 2018 from an abusive household.

Her exhaustive eight-month investigation culminated in a comprehensive 634-page report, which led to the unanimous adoption of all recommended changes by the Riverside County Board of Supervisors. This work significantly influenced social services policies in California.

Regarding trends within her practice, Potashner said, "I have seen the white-collar defense practice be impacted significantly by innovations in the tech space, namely related to the proliferation of cryptocurrency and crimes associated with digital assets.

She continued: "As crypto has become a 'borderless' currency, transactions take place instantly and across several borders, posing new challenges for lawyers who are faced with determining the correct jurisdiction for prosecution, the relevant enforcement agencies to regulate, and how to approach investigations. We are already seeing an uptick in DOJ and SEC investigations relating to crypto-related crimes and I expect this to increase on a global scale as countries continue to navigate the international nature and enforcement of crypto and related cybercrimes."
