Tony Weibell, a partner at Mayer Brown, is known for his expertise in consumer protection, privacy and internet law. A leading litigator in Silicon Valley, he recently joined Mayer Brown. Weibell previously worked at Wilson Sonsini Goodrich & Rosati and had clients such as Google and TikTok for significant cases that set precedents in the digital realm.
While at Wilson Sonsini, Weibell successfully managed the transfer of 17 separate class actions against TikTok to a judge for consolidation under a prior class settlement. This case, involving allegations of data privacy violations, showcases his strategic acumen in navigating multidistrict litigation. In re: TikTok Inc. Consumer Privacy Litigation, 1:20-cv-04699 (N.D. Ill., filed Aug. 11, 2020).
“The biggest challenge in this matter was dealing with scores of plaintiff firms who had filed individual actions in the MDL and persuading all of them that the value of the case was nowhere near what they believed it to be in order to facilitate a settlement,” Weibell said.
Another notable achievement was his representation of Roblox Corporation in a case that dealt with allegations that Roblox’s no-refund policy violated minors’ legal rights to disaffirm online purchases.
V.R. v. Roblox Corporation, 3:22-cv-02716 (N.D. Cal., filed May 5, 2022).
Weibell’s successful defense led to a dismissal of the action, a landmark victory that set a precedent for gaming companies facing similar lawsuits.
His shared insights on current trends highlight the growing challenges in consumer privacy law.
“Regulators, plaintiff firms, and judges are taking a very expansive view of consumer privacy laws and turning yesterday’s common practices into today’s nightmares for companies that handle consumer data,” Weibell said. “Because privacy laws often come with statutory damages of $1,000 to $10,000 per violation, the potential damages in a privacy class action are staggering, reaching $1 trillion in cases where popular tech companies have tens or hundreds of millions of users.”
Beyond his caseload, Weibell is actively involved in the legal community. He volunteers at the San Mateo Superior Court, assisting unrepresented litigants, and is a member of the Academy of Court-Appointed Neutrals. He also contributes to the Rabiej Litigation Law Center, helping to develop best practices for class actions and multidistrict litigation.
