Jeffrey Kessler has been instrumental in shaping the landscape of sports law through his groundbreaking work, particularly in advocating for equal pay and athletes’ rights. Kessler’s notable achievements include securing an equal pay settlement for the Women’s National Team in soccer, a victory that transcended legal realms to garner worldwide public support. This complex case against U.S. Soccer demanded extensive litigation and public advocacy to establish complete pay parity for champion women athletes, including equitable World Cup compensation.
“The equal pay action was fought tooth and nail by U.S. Soccer and required years of litigation and the marshaling of public support throughout the world to achieve complete pay parity for why champion women, including for the World Cup,” Kessler said.
Kessler has also been a key figure in the House litigation against the NCAA, focusing on Name, Image, and Likeness rights for college athletes. House, et al. v. National Collegiate Athletic Association, et al. 4:20-cv-03919, (N.D. Cal., filed June 15, 2020.)
This case involved intricate expert testimony and rigorous legal challenges, including Daubert motions. Kessler’s adept handling of these complexities led to a complete rejection of the NCAA’s expert arguments in favor of the analyses presented on behalf of the athletes.
Kessler’s ongoing efforts against the NCAA are poised to radically transform the organization’s restrictions on athletes.
His commitment to these causes signals a shift toward a fairer system that respects and protects the economic rights of college athletes. The House litigation is scheduled for trial in January 2025, and with Kessler’s continued involvement, significant changes in college sports regulations and athlete compensation are anticipated.
“At the end of the road, there will be a complete transformation of the NCAA’s restrictions and the creation of a fair competitive system to protect the economic rights of college athletes,” Kessler said.
Kessler’s work exemplifies the intersection of law, sports and social advocacy. Through his legal expertise and commitment to justice, he has not only influenced significant legal decisions, but also shaped public discourse on equity and rights in sports. His efforts continue to pave the way for transformative changes in sports law and the broader sports industry.
