Brandon N. Krueger is a shareholder at Sall Spencer Callas & Krueger who has focused his practice almost exclusively on professional responsibility and attorney ethics issues for almost two decades.
He has been intrigued by this area since he first encountered it, representing a client in a malpractice action against a prominent Los Angeles law firm.
“The complexity of these disputes is challenging and fascinating,” Krueger said. “I also find it personally meaningful to work to ensure that attorneys properly fulfill their duties — whether we are advancing that cause by advising lawyers or by vindicating client rights in litigation.”
Last year, Krueger represented a client in obtaining an 8-figure pre-litigation settlement of malpractice claims against a national law firm. The claims arose out of the target law firm’s misguided litigation strategy, which caused significant harm to Krueger’s client. Krueger said he was proud to achieve such a favorable result without his client having to endure the delay, distraction, costs and risks associated with a fully litigated case.
Krueger also mentioned significant challenges he had to overcome, including marshaling the evidence necessary to present a client’s claims in a way that would convince a potential defendant (and its insurer) that a reasonable settlement is clearly superior to litigation.
“In this instance, the client-file was voluminous and required extensive review and analysis. Ultimately, the client-file contained powerful evidence which we were able to use to convince the potential defendant of the wisdom of settlement,” he said.
Analyzing recent trends, Krueger said he believes the increasing adoption of generative artificial intelligence tools has the potential to be extremely disruptive to the legal profession.
“It might deliver profound efficiencies and expanded access to justice, but the ethical implications, as well as the impact upon attorneys’ standard of care over time, are significant areas of concern,” he said.
