In addition to litigating patent cases nationwide for the past 25 years, Stefani Shanberg has also had more than 100 cases in the Northern District of California and dozens before the U.S. International Trade Commission.
"The companies with whom I work are fast-moving, forward-thinking, entrepreneurial, strategic, and creative," she said. "My job is about relationships and results at its core; the technology is important, but it is not the complete picture in IP litigation. I am grateful to have clients willing to litigate cases to move the law forward and create good law for the future."
Currently, Shanberg is the lead counsel for Amazon, Amazon Web Services, and Twitch in a patent infringement case involving live-streaming products.
"The case is pending in the Northern District of California which is significant because we certainly see more patent cases in Texas and Delaware these days, and it is a pleasure when we can litigate in our home court," she said.
Additionally, Shanberg is spearheading Amazon's defense in two ITC investigations initiated by Nokia Technologies Oy and Nokia Corporation. These investigations involve seven patents related to video coding, which Nokia claims are standard essential patents and accuses Amazon and co-respondent HP, Inc. of infringing.
The patents are alleged to be standard essential patents and are asserted against Amazon and co-respondent HP, Inc.'s products including streaming devices and televisions, Shanberg explained.
"Nokia aims to block the importation certain Amazon products from entering the United States based on allegations that the products infringe patents Nokia committed to license on reasonable and nondiscriminatory terms," she said. "The cases are part of a worldwide litigation campaign and have garnered extensive press coverage."
Shanberg said IP litigation is complex and challenging by nature.
"At the beginning of a case, I always focus on finding the path to victory," she said. "Once we overcome the obstacle of crafting a winning theme, we focus on that and it is often the key to overcoming any future obstacles we face."
In her role on the Northern District of California's Patent Instructions and Rules Attorney Advisory Committee, she evaluates improvements to patent litigation procedure, including, for example, how to best manage cases transferred in from other districts and optimization of the district's Patent Local Rules.
