Susman Godfrey's Davida Brook has solidified her reputation as a skilled and dedicated legal advocate through her unwavering commitment to seeking justice for her clients.
Brook, who served as co-lead counsel in Dominion Voting System's landmark defamation lawsuit against Fox News Network and Fox Corporation and settled the case for $787.5 million, continues to represent her client against Newsmax, OAN, My Pillow CEO Mike Lindell, Overstock.com founder Patrick Byrne, Rudy Giuliani and Sidney Powell. "Dominion was the privilege of my career. Setting the record straight on the 2020 Presidential Election and fighting misinformation," Brook said. "We are still litigating with Newsmax, OAN, Mike Lindell, Patrick Byrne and others."
Most recently Brook is representing the New York Times in an action against Microsoft and Open AI in a copyright infringement case accusing the tech mogul of illegally using millions of articles from the publication to train their artificial intelligence model. This watershed complaint is notable as it represents the first instance where a newspaper publisher has taken legal action against developers of a large-language model. The New York Times Company v. Microsoft Corporation, 1:23-cv-11195, (S.D. New York filed Dec. 27, 2023).
"Representing The New York Times in its landmark case against Microsoft and OpenAI is an honor," Brook said. "Creators have rights and those rights should be respected."
The lawsuit raises important questions about intellectual property rights in the digital age. As AI models become more sophisticated and capable of generating human-like responses, the issue of copyright infringement in training data becomes increasingly relevant.
Brook is currently preparing to go to Federal Court in California on behalf of a certified class of plaintiffs suing MindGeek, owner of Pornhub.com and many other popular websites in the United States as part of the first ever class action on behalf of victims of child pornography. This case accuses MindGeek of violating federal sex trafficking and child pornography laws by knowingly posting, enabling the posting of, and profiting from thousands of pornographic videos featuring persons under the age of 18.
