THE COURT:
It is ordered that the opinion filed herein on March 3, 1998, be modified in the following particulars:
1. On page 7,1 line 3, the citation "cf. also Pfizer, Inc. v. Superior Court (1997) 59 Cal.App.4th 840, 845-846." is deleted. Insert a period in place of the semicolon after the words "p. 37."
2. On page 19,2 line 13, at the end of the second full paragraph, the words "the seven sites" are deleted and the following is inserted in their place:
five of the seven sites. FMC does not raise the issue as to the Julian Street site involved in the third trial or the Mouat site in the fifth trial.
3. On page 95,3 line 6 of the first full paragraph, the words "The London defendants" are changed to "FMC" so the sentence reads:
FMC responded that the evidence was irrelevant and in any event unduly prejudicial.
4. The caption of the case will remain unchanged. (See §§ 202, 206 of the Cal. Style Manual.) However, the listing of the attorneys at the end of the opinion will be modified as follows:4 In place of the words "Attorneys for Appellant," substitute the words "Attorneys for FMC Corporation, Appellant." In place of the words "Attorneys for Amicus Curiae on behalf of appellants," substitute the words "Attorneys for Amicus Curiae on behalf of Plaisted and Companies, et al., Appellants." In place of the words "Attorneys for Respondent," substitute the words "Attorneys for Plaisted and Companies, et al., Appellants."
Appellant FMC Corporation's petition for rehearing is denied.
This modification does not affect the judgment.
