Summary

The U.S. Supreme Court agreed to review Octane Fitness LLC v. Icon Health & Fitness Inc., a case from the United States Court of Appeals for the Federal Circuit involving a dispute over the patent to an elliptical exercise machine. The district court granted summary judgment for a competitor, holding that the competitor's competing elliptical machine did not the patent. The appellate court agreed, finding that the competitor's product was different enough that it did not infringe. In particular, the competitor's machine utilized different parts and structures that made it distinct from the patented device.
