Summary

The CA Supreme Court agreed to review People v. Zarate, a case from the Fourth District Court of Appeal on the issue of calculating presentence conduct credit pursuant to the former version of Penal Code Section 4019. Defendant was charged with sale or transportation of marijuana and possession of marijuana. He was sentenced pursuant to a plea agreement. He was awarded presentence credit pursuant to a former version of the applicable Penal Code sections. He argued this was in error because the court should have used the amended version of the applicable statute. This court will decide whether defendant’s presentence credit was properly calculated.
