Summary

The CA Supreme Court agreed to review People v. Lara, a case from the 6th District Court of Appeal involving a defendant who entered a plea of no contest to the charged offense, and admitted certain probation violations as part of a plea bargain, but did not admit allegations concerning a prior conviction. The trial court found the defendant's prior conviction necessarily affected calculation of his presentence credits. The issue was whether the court had discretion in determining whether a prior strike enhancement, which was ‘dismissed’ under the plea agreement, affected the presentence credits.
