Summary

The U.S. Supreme Court will review Kawashima v. Holder, a case from the 9th Circuit Court of Appeal, in which the petitioner pled guilty to aiding and assisting the preparation of a false tax return. An Immigration Judge found that the conviction constituted an “aggravated felony” and ordered the petitioner removed to Japan. An issue was whether the BIA must determine what types of evidence it may consider to determine the total loss suffered by the government as a result of the crime, before finding that it is an aggravated felony.
