THE COURT:
It is ordered that the opinion filed herein on February 25, 1998, be modified in the following particulars:
1. On page 16, line 19,1 delete "§ 199", so the line reads:
"art. XIX, § § 4, 5; Sts. & Hy. Code, § 2101, subds. (c) and"
2. On page 18, line 18,2 delete "§ 199", so the line reads:
"§ 2101, subds. (c) and (d); Kizziah v. Department of"
3. On page 22, line 14,3 after "Code," insert: "§§ 163, 164.), so the line reads:
"powers and duties of the Department. (See e.g., Sts. & Hy. Code, §§ 163, 164.)
4. On page 22, line 15,4 delete "§ 199.)".
