        It is ordered that the opinion filed herein on August 31, 1999 be modified in the following particulars:
        1.        Respondent's motion to modify opinion to delete a reference to the reporter's transcript regarding Lerner's net worth is granted. The slip opinion, filed on August 20, 1999, is hereby modified to delete the words "Lerner's net worth was in excess of $47 million"** from the last line of page two of the typed opinion, and substitute the words "Lerner was extremely wealthy" so that the last full sentence on page two reads: "By the time of trial in this matter, Lerner was extremely wealthy."
        There is no change in the judgment.
