Facts

The City of San Clemente filed a lawsuit against defendants SunCal Marblehead LLC and Arch Insurance Company after work had stopped on the 248-acre Marblehead Coastal Project due to the bankruptcy of SunCal and Lehman Bros., the company financing the project.

After negotiations to complete the improvements most affecting the public failed, the City
filed suit.

Result

The parties agreed to settle the dispute, under which certain roads, utilities, and other projects would be completed.
