Facts
On June 29, 2008, Aurelio Cruz was involved in an altercation at the Crazy Horse Restaurant in West Covina after a fight broke out between two girls and escalated between several patrons and security guards. During the fight, Cruz was tackled by Crazy Horse security guards.
Contentions
PLAINTIFF'S CONTENTIONS:
Cruz filed suit against CHWC Inc., Crazy Horse's corporate entity, alleging negligence. Cruz contended that CHWC negligently hired, trained, and retained security personnel, who were unlicensed and improperly trained. He further alleged that security mismanaged control over the initial fight by failing to initiate proper crowd control techniques that properly trained security would have used in such situations.
Injuries
Cruz was hospitalized, sustained a right broken distal tibia, and underwent open reduction internal fixation. He also suffered a laceration to his forehead and was unable to work for two years.
Result
The court rendered a verdict for Cruz, awarding him $1,176,063.
