Twenty-two homeowners of a nearly 300-unit housing development in Chino filed a claim against developer D.R. Horton Los Angeles Holding Co. Inc., alleging there was a number of construction defects in their properties.

The developers conducted a number of repairs in November 2011 in accordance with SB 800, California's Right to Repair law. Following the completion of the SB 800 repairs, nine plaintiffs dismissed their claims against the developer and 13 continued with the action.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiffs claimed their homes contained a number of defects, including but not limited to missing, broken, or loose roofing tiles and other roofing defects, warped fences, cracking concrete in patios and garages, cracks in stucco resulting from improper mixture or poor application, separating vinyl flooring and other flooring issues, cracked tiles on bathroom and kitchen counters, cracking interior drywall, improperly waterproofed windows and sliding glass doors, and various electrical and plumbing issues.

Settlement Discussions

Plaintiff's opening demand was $8,000 per home. Defendant issued a 998 for $3,000 per home.

Result

The 13 remaining plaintiffs settled out of court prior to the case's June 2014 trial date for a total of $41,000 paid jointly by the defendant and cross-defendant.
